These Terms and Conditions ("Terms") constitute a legally binding agreement between RatingBaazar, a proprietorship business ("RatingBaazar", "Company", "we", "us", or "our"), and any individual or business entity ("Business Owner", "User", "you", or "your") who registers for, subscribes to, accesses, or otherwise uses the RatingBaazar platform, website, dashboard, QR codes, stickers, standees, and any related services (collectively, the "Service" or "Platform"). By registering an account, purchasing a plan, or using the Service in any manner, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

1. Definitions

  • "Business Owner" means the paying subscriber who registers a business on the Platform.
  • "End Customer" or "Customer" means any third-party individual who scans a RatingBaazar QR code displayed by a Business Owner.
  • "QR Code" means the unique QR code(s) assigned to a Business Owner's registered business upon successful plan purchase.
  • "Google Review URL" means the direct Google Business review link submitted by the Business Owner at the time of registration.
  • "AI-Generated Review" means the draft review text generated by the Platform's artificial intelligence engine on the review suggestion page.
  • "Plan" means any paid subscription package offered by RatingBaazar.

2. Description of Service

RatingBaazar is a QR-code-based, AI-assisted review facilitation platform. The Service allows a Business Owner to register a business, link a Google Review URL, purchase a subscription Plan, and receive one or more unique QR codes together with a physical sticker and/or QR standee. When an End Customer scans the assigned QR code, the Customer is directed to a review-suggestion page where an AI-generated draft review is displayed. The Customer may regenerate the draft, change its language, copy the text, or use a "Copy and Post to Google" function that copies the text and redirects the Customer to the Business Owner's Google review page.

The sole and complete function of the Service is to simplify and streamline the process of drafting and submitting a review. RatingBaazar does not create, post, submit, verify, or control any review on Google or any third-party platform on behalf of any person.

3. Account Registration and Eligibility

To use the Service, a Business Owner must provide accurate, current, and complete registration information, including a valid Google Review URL for the business being registered. You must be legally authorised to register and represent the business you enrol on the Platform. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4. Plans, Payment, and Pricing

Access to QR codes, stickers, and standees is provided only upon successful purchase of a paid Plan. All prices, Plan features, and validity periods are as displayed on the Platform at the time of purchase and are subject to change without retrospective effect on already-purchased Plans. Payment must be completed in full through the payment methods made available on the Platform before any Plan, QR code, sticker, or standee is issued or dispatched.

Additional stickers or standees beyond the quantity included in a purchased Plan are chargeable separately at the prevailing rates displayed on the Platform at the time of the additional request.

5. QR Codes, Stickers, and Standees

Upon successful payment, RatingBaazar will assign unique QR code(s) to the registered business and dispatch a physical sticker and/or QR standee to the address provided by the Business Owner. The Business Owner may alternatively, or additionally, download the assigned QR code as a JPG or PDF file from the dashboard for self-printing or for sharing with third parties, subject to the condition that the QR code is used only in connection with the registered business and is not altered, forged, or misused in any manner.

RatingBaazar is not responsible for delays, loss, or damage to physical stickers or standees occurring during courier or postal transit, once dispatched to the courier partner.

6. AI-Generated Review Content

The review text displayed to an End Customer is generated automatically by an artificial intelligence system based on limited inputs and general patterns. RatingBaazar does not guarantee that AI-generated content will be accurate, factual, free of errors, or reflective of any End Customer's actual personal experience with the business. The End Customer retains full and sole discretion to edit, regenerate, change the language of, accept, reject, or decline to use any AI-generated suggestion. Any review ultimately copied and/or submitted on Google is the sole responsibility of the End Customer who submits it, and not of RatingBaazar or the Business Owner.

7. Scan Count, Click Count, and No Guarantee of Reviews

The Platform's dashboard displays two independent counters to the Business Owner: (a) a "Scan Count", which increases every time an End Customer scans the assigned QR code, and (b) a "Copy and Post to Google" click count, which increases every time an End Customer clicks the corresponding button on the review-suggestion page.

You expressly acknowledge and agree that these counters are activity indicators only and do NOT represent, confirm, or guarantee that a corresponding review has actually been posted, published, or submitted on Google. Once a Customer is redirected to Google's website, RatingBaazar has no technical access to, visibility into, or control over Google's platform, and cannot track, verify, or confirm whether the Customer completed, submitted, edited, or abandoned ("backed out of") the review process on Google. Any discrepancy between the Scan Count, the click count, and the actual number of reviews appearing on Google is expected and shall not be treated as a defect, malfunction, or breach of service by RatingBaazar.

RatingBaazar's core purpose is limited strictly to making the process of writing and submitting a review simpler and faster for End Customers. Purchase of a Plan and successful payment does NOT guarantee, promise, or assure that the Business Owner will receive any reviews, a specific number of reviews, positive reviews, or any increase in ratings, visibility, footfall, or business outcomes whatsoever. If, after successful payment and activation of a Plan, End Customers do not leave reviews for any reason, RatingBaazar bears no responsibility, obligation, or liability of any kind, and no compensation, credit, or refund shall arise from this fact alone.

8. User Obligations

  • Provide true, accurate, and lawful business information and a genuine Google Review URL belonging to your own business.
  • Use QR codes, stickers, and standees strictly for the registered business and not transfer, resell, or misuse them for any unrelated entity.
  • Not incentivise, coerce, pay, or pressure End Customers into posting fake, fraudulent, or dishonest reviews.
  • Comply with Google's own review policies and all applicable laws relating to consumer reviews and advertising.
  • Not reverse-engineer, copy, scrape, or misuse the Platform's AI engine, software, or underlying technology.

9. Prohibited Uses

You shall not use the Service for any unlawful purpose, to generate defamatory, fraudulent, or misleading content, to impersonate any person or business, to interfere with the security or normal operation of the Platform, or in any manner that violates Google's terms of service or applicable consumer protection, advertising, or IT laws.

10. Intellectual Property

All content, software, design, trademarks, logos, and material on the Platform, including the AI review-generation engine, dashboard, and QR-code system, are the exclusive property of RatingBaazar or its licensors. No licence is granted to you except the limited, non-transferable right to use the Service for your own registered business during the validity of your Plan.

11. Third-Party Platforms (Google)

RatingBaazar is an independent facilitation platform and is not affiliated with, endorsed by, or a representative of Google LLC. Redirection to a Google review page is provided purely as a convenience. RatingBaazar has no control over, and disclaims all responsibility for, Google's website availability, functionality, review policies, moderation decisions, removal of reviews, or any changes Google may make at any time without notice.

12. Termination and Suspension

RatingBaazar reserves the right to suspend or terminate any account, without prior notice, if it reasonably believes these Terms have been violated, fraudulent activity is suspected, or misuse of QR codes or AI-generated content has occurred. Termination for cause shall not entitle the Business Owner to any refund.

13. Limitation of Liability

To the maximum extent permitted by applicable law, RatingBaazar, its proprietor, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of business, loss of reputation, loss of expected reviews, or loss of revenue, arising out of or in connection with the use of, or inability to use, the Service. RatingBaazar's total aggregate liability for any claim arising under these Terms shall not exceed the amount actually paid by the Business Owner for the specific Plan giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless RatingBaazar, its proprietor, and its representatives from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Service, or any content or review activity connected with your registered business.

15. Modifications to These Terms

RatingBaazar may revise these Terms at any time by posting an updated version on the Platform with a revised effective date. Continued use of the Service after such changes constitutes acceptance of the revised Terms.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to applicable law, the courts at Ahmedabad, Gujarat, India shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service.
